In the Retail Motor Industry the employer is obliged to make certain
statutory deductions and payments. Examples of statutory deductions include
Provident Fund, Union Fees, Council Levies etc. and statutory payments include
Overtime, Leave Pay, Bonuses etc.
If an employee becomes aware that the employer is not paying or deducting
statutory monies, the employee needs to inform MISA in order to assist.
Upon receipt, MISA will request the relevant documentation from the
employee and in some instances, the employer in order to refer the matter to
the Motor Industry Bargaining Council (MIBCO) for investigation and
MIBCO has designated agents who has the authority to access information
at the workplace and to enforce payment when due.
Currently, MIBCO provides feedback on investigation to MISA on a monthly
basis, and as such, MISA is not actively involved in these investigations.
In a Nutshell: if you suspect your employer is in contravention
of any of the above, it has to be reported to MISA.
